This website is operated by Gumo Health Pty Ltd (ABN 93 696 083 495 / ACN 696 083 495), trading as Gumo ("we", "us", "our"). Gumo offers this website, including all information, tools and products available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants and contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms of this agreement, then you may not access the website or use any Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

1. Eligibility and Age Restriction

Our products are not suitable for children under 15 years of age. They are intended for use by healthy individuals aged 15 years and over, and should only be used under medical or dietetic supervision. We do not knowingly sell to, or accept orders from, persons under 15.

If you are under 18 years of age, you may only use our products with the knowledge and consent of a parent or legal guardian, and any purchase must be placed and paid for by a parent or legal guardian aged 18 or over. By placing an order, you represent that you are at least 18 years of age, or that a parent or legal guardian has placed the order on your behalf and consents to your use of the products.

We reserve the right to request proof of age at any time and to refuse or cancel any order where we believe this clause has not been complied with.

You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

2. Health and Product Disclaimer

Our products are dietary supplements, not medicines. Nothing on this website constitutes medical, nutritional or health advice, and no statement on this site should be interpreted as a claim to diagnose, treat, cure or prevent any disease or medical condition.

You should consult a qualified healthcare professional before using our products, particularly if you:

3. General Conditions

We reserve the right to refuse Service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and may involve transmissions over various networks and changes to conform to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

The headings used in this agreement are for convenience only and do not limit or otherwise affect these Terms.

4. Products and Availability

All products are subject to availability. We reserve the right to limit the quantities of any products we offer, to limit sales of our products to any person, geographic region or jurisdiction on a case-by-case basis, and to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.

We have made every effort to display the colours, images and descriptions of our products as accurately as possible. We cannot guarantee that your device's display will accurately reflect the appearance of the product. Product packaging, formulation and appearance may be updated from time to time; the product you receive may differ in minor respects from the images shown.

Products purchased are for personal use only and are not for resale, unless you have entered a separate written wholesale agreement with us.

5. Pricing and Payment

All prices are listed in Australian Dollars (AUD) and, where applicable, are inclusive of GST.

We reserve the right to modify prices at any time without notice. We are not liable to you or to any third party for any modification, price change, suspension or discontinuance of any product.

We reserve the right to refuse or cancel any order, and may in our sole discretion limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed under the same customer account, the same payment card, or the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we may attempt to notify you using the contact details provided at the time of the order. If we cancel your order after payment has been taken, we will refund you in full.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your account and payment information so that we can complete your transactions and contact you as needed.

6. Orders, Shipping and Risk

Once an order is placed, you will receive an order confirmation email. This confirms we have received your order; it does not constitute acceptance of your order. Our acceptance occurs when we dispatch the products.

Delivery timeframes shown on our site are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather or other events outside our reasonable control.

Risk in the products passes to you on delivery to the address you provide. Title in the products passes to you once payment has been received in full.

If you are ordering from outside Australia, you are the importer of record and are responsible for ensuring the products may lawfully be imported into your country, and for any duties, taxes or customs charges. Some jurisdictions restrict or prohibit the importation of dietary supplements. We are not responsible for products seized, delayed or refused entry by customs authorities.

7. Returns, Refunds and Your Consumer Rights

Our Refund Policy sets out how returns and refunds are handled and forms part of these Terms.

For health and safety reasons, we are unable to accept returns of opened or used consumable products unless the product is faulty or does not match its description.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You accept responsibility for all activities that occur under your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

9. Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content:

  • for any unlawful purpose or to solicit others to perform unlawful acts;
  • to violate any international, federal, state or territory regulations, rules, laws or local ordinances;

We reserve the right to terminate your use of the Service for breaching any of the prohibited uses.

All content on this site, including text, graphics, logos, images, product photography, packaging design, formulations, brand names and the "Gumo" name and marks, is our property or that of our licensors and is protected by Australian and international intellectual property laws.

11. User Comments, Reviews and Submissions

If you send us creative ideas, suggestions, proposals, reviews, photographs or other materials ("Comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use them in any medium, without compensation to you.

You agree that your Comments will not violate any right of any third party, will not contain unlawful, abusive or obscene material, and will not contain any computer virus or malware. You may not use a false email address or otherwise mislead us as to the origin of any Comments. You further agree not to make false statements or claims regarding health outcomes, and not to make therapeutic claims about our products.

We are under no obligation to maintain any Comments in confidence, to pay compensation for any Comments, or to respond to any Comments. We may, but have no obligation to, monitor, edit or remove Comments we determine to be unlawful, offensive, threatening, defamatory or otherwise objectionable.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site.

If in our sole judgement you fail to comply with any term of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

Obligations and liabilities incurred prior to termination survive the termination of this agreement.
